By accessing or using the LabOpsTech platform ("Service"), operated by LearnITTechIndia.com ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to:
• Individual developers ("Developers")
• Organizations and their administrators ("Organization Admins")
• Organization members and employees
• Educational institutions and their students

By creating an account, you represent that you are at least 18 years of age, or if you are under 18, that you have obtained parental or guardian consent to use the Service.

LabOpsTech is a multi-tenant Software-as-a-Service (SaaS) platform that enables users to:
• Provision and manage cloud lab environments on AWS, Azure, Google Cloud Platform, IBM Cloud, and Oracle Cloud
• Access pre-configured lab templates for educational and development purposes
• Use the Cloud IDE for designing cloud architectures
• Participate in gamification features including quizzes, points, and certifications
• Collaborate within organizations through team management features

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

3.1 Account Registration
To use certain features of the Service, you must register for an account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Types
• Developer Accounts: Individual accounts with auto-approved lab requests
• Organization Accounts: Business/educational accounts with admin-managed users
• Organization Admin Accounts: Accounts with administrative privileges within an organization

3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for:
• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of applicable fees
• Extended periods of inactivity

4.1 Cloud Provider Credentials
You are responsible for providing and managing your own cloud provider credentials (AWS, Azure, GCP, etc.). We do not store your cloud provider passwords or secret keys in plain text.

4.2 Resource Costs
• Cloud resources provisioned through LabOpsTech will incur costs from the respective cloud providers
• You are solely responsible for all cloud infrastructure costs incurred through your use of the Service
• We provide cost estimates for informational purposes only; actual costs may vary
• You are responsible for monitoring and managing your cloud spending

4.3 Resource Management
• You must destroy lab resources when no longer needed to avoid unnecessary charges
• We are not responsible for orphaned resources or unexpected cloud charges
• We recommend setting up billing alerts with your cloud providers

4.4 Platform Fees
• Subscription fees are billed according to your selected plan
• All fees are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days notice

You agree not to use the Service to:
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or other malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Engage in cryptocurrency mining without explicit authorization
• Launch attacks against other systems or networks
• Store or transmit illegal content
• Resell or redistribute the Service without authorization
• Reverse engineer or attempt to extract source code from the Service
• Use the Service for competitive analysis or to build a competing product

Violation of this policy may result in immediate account termination without refund.

6.1 Data Collection
We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to such collection and processing.

6.2 Data Security
We implement industry-standard security measures to protect your data, including:
• Encryption of data in transit and at rest
• Regular security audits and penetration testing
• Access controls and authentication mechanisms
• Secure cloud infrastructure

6.3 Data Retention
We retain your data for as long as your account is active or as needed to provide the Service. You may request deletion of your data subject to legal retention requirements.

6.4 Third-Party Services
The Service integrates with third-party cloud providers. Your use of these services is subject to their respective terms and privacy policies.

7.1 Our Intellectual Property
The Service, including its original content, features, and functionality, is owned by LearnITTechIndia.com and is protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content
You retain ownership of any content you create using the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of providing the Service.

7.3 Feedback
Any feedback, suggestions, or improvements you provide regarding the Service may be used by us without any obligation to compensate you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

8.1 We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Loss of profits, data, or business opportunities
• Cloud infrastructure costs incurred through your use of the Service
• Service interruptions or downtime
• Actions of third-party cloud providers

8.2 Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8.3 Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless LearnITTechIndia.com, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your cloud resource usage and associated costs
• Any content you submit or transmit through the Service

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
• Posting the updated Terms on the Service
• Sending an email to your registered email address
• Displaying a prominent notice within the Service

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

11.2 Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through:
• Good faith negotiations between the parties
• Mediation by a mutually agreed mediator
• Binding arbitration in accordance with applicable arbitration rules
• The courts of Bangalore, Karnataka, India shall have exclusive jurisdiction

11.3 Class Action Waiver
You agree to resolve any disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
